Terms and Conditions of Business
1. Families must complete our Family Registration Form and sign the Terms and Conditions and return both to the agency, before they are accepted as clients. If registering online, filling the online registration Form constitutes confirmation of acceptance of the agency's Term's & Conditions. Nannies can only be booked for family when all this documentation and full payment has been received. Should there be any delays or the documentation is not satisfactory, the agency reserves the right to cancel the placement at any stage.
2. ROYAL RECRUITMENT (later RR) , ('Company') acts as an agent to introduce suitable candidates to work as nannies, maternity nurses/nannies, Au Pairs, Cleaners and babysitters ('Applicant') for it's Clients ('Client'). The company does not employ any of the applicants, directly or indirectly. Applicants are introduced to Clients on the basis that they will be employed by the Client, unless the Applicant is self-employed.
3. Clients undertake to notify the Company immediately upon any offer being made which results in the engagement of an Applicant.
4. Fees charged relate to one engagement only. If an Applicant subsequently rejoins the Client at any time in the future, the Client undertakes to inform the Company and pay the relevant introduction fee again.
5. Accounts must be paid within ten days of the invoice date failing which the engagement may be cancelled and a late payment fee of £10 for every unpaid week will apply!
6. All engagement fees quoted are exclusive of V.A.T., Applicant's salary and other chargeable expenses of the applicant and/or Company.
7. In the case of overseas Clients, payment must be made within ten days of the invoice date and in any event before the applicant leaves the U.K. to take up her/his position.
8. In the case of the cancellation of any engagement by the Client, half the full fee is payable with respect to that Applicant shall be payable by the Client.
9. The full fee from the engagement date shall be payable by the Client, even though any awaited birth may be delayed.
10. Clients undertake to notify the Company if any Applicant for a temporary position remains with the Client, and in such event an additional full fee for a permanent introduction appropriate to the Applicant shall be payable by the Client.
11. All introductions of Applicants by the Company and their personal details shall be kept strictly confidential by Clients. Clients undertake accordingly not to disclose any introductions to third parties. Any breach of this undertaking resulting in the employment of an Applicant by a third party renders the Client liable for full payment of the Company's introduction fee.
12. Clients agree to reimburse reasonable travelling expenses incurred by Applicants attending interviews.
13. The Company will only grant refunds in the following circumstances:
A) Should the nanny leave within the first 6 weeks, a replacement will be offered free of charge. If no suitable replacement is found within 2 months, agency will refund 65 % of the placement fee. If the family does not wish to accept the replacement nanny, the agency will offer a refund of 25 % of the placement fee.
B) Should the nanny/candidate leave after the first 6 weeks of employment, Royal Nannies will guarantee a 30% discount for finding a new nanny, but will not offer any refunds from the previous invoice.
C) Please note that once the family advises the agency to look for a replacement nanny/ aupair and then finds a new nanny / au pair via another source, the agency will NOT offer any refund.
D) There will be no free replacement or refund given should there be reasonable grounds to believe that the Nanny's working conditions and/or the way the family treated the nanny were unsatisfactory, should the client/family refuse to pay candidate's tax, or should there be a record of several unsuccessful placements in the family. (Royal Recruitment agency's decision will be final in this respect).
E) No claim for refund can be entertained by the Client where the payment in full has not been received by the Company within ten days of the invoice date.
F) There will be no free replacement of refund given if manager's discount was applied and if the nanny leaves within the first 6 weeks.
14. All instances of termination of employment where a refund is claimed must be notified in writing to the Company within three days of the termination of employment.
15. The Company uses its reasonable endeavours to establish the suitability of any Applicant for introduction to the Client. However, all responsibility for ascertaining the suitability of an Applicant for the engagement remains with the Client. The Company does not accept under any circumstances and excludes liability for any loss, damage, expenses, or delay incurred or suffered by the Client, the Clients family, servants, or the Client¹s assets, allegedly arising from the acts, omission or character of the Applicants introduced by the Company, or, to the extent permitted by law, in respect of services provided by the Company.
16. No variations to these terms of business, either express or complied, may be made without the written consent of a Director of the Company.
17. If our candidate is solicited to work for the client with the intention of bypassing the agency fees then the client will be invoiced the ammount for original agency fee + £500 penalty charge!
18. Terms and Conditions may be subject to change at any time and without notice, however all changes will be posted here on the website. It's your responsibility to check these Terms and Conditions in case there are any changes. Continuing to use the site and our services after a change has been made is your acceptance of the changes.
19. Any material found within the pages of our websites, such as www.royalnannies.co.uk or www.nannyagencylondon.co.uk or www.nannieslondon.co.uk, including text or images may not be copied, reproduced, republished, downloaded, posted, broadcast or transmitted in any way. 20. These terms of business are covered by English law and all disputes arising out or in connection therewith shall be subject to the jurisdiction of the English courts.
